What If My Employer/Boss Will Not Report My Injury?

You employer is required to report your injury to the Industrial Commission of Arizona. However, if he or she does not do so, it is your responsibility to file your claim within one year’s time for the date that your accident and injuries occurred. Not filing within the one year time frame because your employer failed to report the accident to the Industrial Commission of Arizona is not a valid excuse, and it is unlikely that any leniency will be given on your behalf. Hopefully, your employer is aware that he or she is legally obligated to require his or her workers’ compensation insurance carrier and the Industrial Commission of Arizona within 10 days of receiving notice of the workplace accident from you, and that failure to do so is a violation of the law that carries significant penalties.
