What If My Employer Does Not Carry Workers’ Compensation Insurance?

Above, it is noted that all employers who have one or more employee(s) in the state of Arizona are required under law to carry workers’ compensation insurance. If your employer does not carry workers’ compensation insurance and you believe yourself to be an employee, not an independent contractor, you have the right to seek benefits. In fact, per Arizona Revised Statutes Section 23-932, an employer who does not carry workers’ compensation insurance and is legally obligated to do so is guilty of a Class 6 felony. Your employer may face criminal and civil charges for depriving you of your right to workers’ compensation benefits.
